Terms of the agreement

Online store http://mondopelle.it (hereinafter – Online store) on the one hand, and the customer of goods (hereinafter – Buyer) on the other hand, undertake to comply with the terms of this Agreement.
1. Receiving and processing of the order
1.1. By placing an order on http://mondopelle.it, the Buyer agrees to these terms and conditions.
1.2. The Seller shall sell the Goods in accordance with the current price list published on the Seller’s website, and the Buyer shall pay for and accept the Goods in accordance with the terms and conditions of this Agreement.
1.3. This Agreement is an official document of Seller.
1.4. By registering on http://mondopelle.it, the Buyer agrees to provide true, accurate information about himself and his contact details.

1.5. The Buyer, by providing this data, also expresses its consent to the Seller’s processing of the personal data provided by the Buyer on the territory of the whole world. The Seller undertakes not to disclose the Buyer’s data specified during registration on the website and when placing an Order to persons unrelated to the execution of the Order. Personal data is stored for the purpose of providing the service of selling the products presented on http://mondopelle.it.
Online store reserves the right to use this information for marketing purposes (analysis of data on sales of goods, analysis of site traffic, electronic mailing).
1.6. Acceptance by the Buyer of the terms and conditions of this Agreement is carried out by means of entering by the Buyer of the relevant data in the registration form in the order form (application) on the website. The buyer has the right to edit the registration information about himself.
1.7. The Seller is not responsible for the content and accuracy of the information provided by the Buyer when placing the Order.

2. payment of the Order
2.1. Payment for the executed Order shall be made by bank transfer, by 100% transfer of funds to the Seller’s settlement account. Confirmation of payment is the issuance to the Buyer of a confirmation (invoice) by the relevant payment system. In order to issue an invoice, the Seller reserves the right to request the Buyer’s personal data (place and date of birth of the credit card holder )
2.2. The price for each item of Goods is displayed on the website in the catalog.
2.3. Prices for any items of the Goods listed on the website may be unilaterally changed by the Seller without notice to the Buyer. If the price of the ordered items of the Goods changes after the Buyer has made the payment, the Seller shall have the right not to inform the Buyer of the changes. In any case, the goods are sold at the price set at the time of payment, the price.
2.4. Buyer makes 100% prepayment. The order shall be accepted for execution only after 100% receipt of the Buyer’s funds to the Seller’s settlement account. 2.7. After placing an order, the Buyer receives a message to the e-mail address specified during registration that his order has been accepted by the automatic order management system, and a representative of the online store will contact him shortly to confirm the order.
2.8. An order shall not be deemed to have been placed if the Buyer has not passed the 100% prepayment stage.

3. Delivery
3.1. The cost of delivery is not included in the price of the Goods and shall be paid by the Buyer separately, in accordance with the tariffs of forwarding organizations performing delivery and specified in the process of order placement.
3.2. If the Buyer provides false information about his contact details, the Seller shall not be liable for improper fulfillment of the Order.
3.3. The Buyer understands the possibility of a situation in which delivery will take more than 5 working days (due to the peculiarities of the delivery service; large volume of orders and in connection with this lengthening of the terms of each order, force majeure, etc.). At the same time online store http://mondopelle.it does not assume any obligations to compensate any losses of the Buyer related to late delivery of the order. If the Buyer is not satisfied with the delivery terms, he/she has the right to cancel the order on the day of its placement by contacting the manager of the online store http://mondopelle.it.

4. Checking the delivered goods
4.1. Upon receipt of the order, the Buyer shall check the quantity and quality of the goods received.

5. Order exchange and return
5.1. The Buyer has the right to refuse the ordered Goods at any time prior to the execution of the Order.
5.2. The Buyer has no right to refuse a paid Order of proper quality, once the order has been placed and already shipped to the Buyer’s address.
5.3. The Buyer, if desired, may request the Seller to exchange the Goods for another, after the order has been placed and payment for a particular item has been made, but only before the Goods are shipped to the Buyer’s address. The Buyer should contact the Seller by e-mail or telephone regarding this matter. You can exchange the Goods for a similar product of the same price or for another model by paying the difference in price. If the requested item is available and mutually agreed upon, the item may be replaced. Seller reserves the right not to accept an exchange.
5.4. Terms of exchange and return of Goods of proper quality:

• The goods must not have any traces of use, its packaging, trade dress, consumer properties, seals, factory labels, as well as all documents received from the Seller must be preserved;
• In case of exchange or return of Goods of proper quality purchased on the site, the Buyer shall pay the cost of delivery there and back.

6. Order return
6.1. If the Seller delivers the Order of improper quality, the Buyer shall immediately contact the Seller and report the defect. The goods must be unused and in the same condition as received by the Buyer must be sent back to the Seller. The Buyer shall have the right to replace or return these Goods within 14 days, after receipt of the defective goods at the Buyer’s address.
6.2. Return or exchange of goods of improper quality shall be at the expense of the Seller.
6.3. The amount paid by the Buyer for the Goods of improper quality shall be refunded to the Buyer within 10 calendar days after receipt of the improper goods by the Seller. The refund will be made only after the goods have been received at the Seller’s address.
6.4. If during consideration of the claim for return of the Goods of improper quality, it will be established that the Goods have been in use, have defects and damages after poor use, not due to the fault of the factory-manufacturer, are in incomplete set or not in the factory package, then the exchange/return is not made.

7. Copyrights
7.1. All textual information and graphics on the website are the property of the Seller.

8. Terms of the agreement
8.1. Online store http://mondopelle.it reserves the right to change the terms of this Agreement, and the online store is obliged to inform the Buyer about all fundamental changes in the Agreement by e-mail, and the Buyer agrees to receive such messages from the online store.
8.2. Online store http://mondopelle.it is obliged to provide free access for the Buyer to the terms of this Agreement on its website.

9. Disclaimer of liability
9.1. The online store http://mondopelle.it may make changes to the materials and services provided on this site, as well as the products and prices mentioned therein, at any time without notice.
9.2. Under no circumstances shall http://mondopelle.it be liable for any damages (including damages for loss of profits, data or business interruption) arising out of the use or inability to use this site.

10. Rights, duties and responsibilities of the parties
10.1. The Seller shall not be liable for improper use of goods ordered on the website by the Buyer.
10.2. The Seller is entitled to transfer its rights and obligations to fulfill Orders to third parties.
10.3. In accordance with paragraph 4 of Art. 16 Federal Law “On Information, Information Technologies and Information Protection” Seller undertakes to: prevent attempts of unauthorized access to information and/or its transfer to persons not directly related to the execution of Orders; timely detect and suppress such facts.
10.4. The Buyer agrees to receive notifications, special offers of the online store, announcements and special promotions. Seller shall notify Buyer by email, text message or telephone. Buyer may unsubscribe from receiving emails at any time by using the “unsubscribe” link provided in each newsletter.
10.5. Title to the Order, as well as the risk of accidental loss or damage thereto, shall pass to the Buyer upon receipt of the Goods.
